Beautiful.ai affiliate program terms of service

1. Program Overview

These Terms of Service ("Terms") govern participation in the Beautiful.ai Affiliate Program ("Program"), operated through PartnerStack. By applying to or participating in the Program, you ("Affiliate," "Partner," or "you") agree to be bound by these Terms. Beautiful.ai, Inc. ("Beautiful.ai," "Company," or "we") reserves the right to update these Terms at any time, with notice provided through PartnerStack.

2. Program Enrollment

2.1. Participation in the Program is by application only. Beautiful.ai reserves the right to accept or reject any application at its sole discretion.

2.2. Affiliates must provide accurate and complete information during the application process, including but not limited to: legal name, website or social media channels, promotional methods, and audience demographics.

2.3. Beautiful.ai may terminate an Affiliate's participation at any time, with or without cause, by providing written notice.

2.4. Affiliates may withdraw from the Program at any time by providing written notice to Beautiful.ai.

3. Commission Structure

3.1. Commissions are earned when a new customer referred by the Affiliate completes a qualifying paid subscription purchase through the Affiliate's unique tracking link.

3.2. The following commission rates apply:

• Pro Annual Plan ($144/year): 30% commission
• Pro Monthly Plan ($45/month): 30% commission
• Team Annual Plan ($480/user/year): 15% commission
• Team Monthly Plan ($50/user/month): 30% commission

3.3. Commissions are calculated on the subscription price only, excluding:

• Sales tax and VAT
• Processing fees (credit card fees, transaction fees)
• Any discounts, promotions, or coupons applied to the sale

3.4. Commissions apply to the initial transaction only:

• For annual plans: commission is paid on the first year only. Renewals are excluded.
• For monthly plans: commission is paid on the first month only. Subsequent months are excluded.

3.5. No commission is owed on:

• Subscription renewals or expansion (additional seats, plan upgrades after initial purchase)
• Refunded or charged-back transactions
• Transactions flagged as fraudulent
• Revenue from customers who fail to pay (bad debts)
• Free trials that do not convert to a paid subscription

3.6. Beautiful.ai reserves the right to modify commission rates with 30 days' written notice. Changes will not apply retroactively to commissions already earned.

4. Referral Qualification

4.1. A referral qualifies for commission when a new customer:

• Clicks the Affiliate's unique tracking link
• Converts to a paying subscriber within 30 days of the end of their free trial experience
• Completes payment for a qualifying plan

4.2. The referral must be a new customer who has not previously held a paid Beautiful.ai subscription.

4.3. Self-referrals (referring yourself, your own company, employees, or contractors) are prohibited and will not earn commission.

5. Payment Terms

5.1. Commissions are verified and paid out 30 days after the customer's subscription starts. This verification period protects against refunds and chargebacks.

5.2. If a referred customer cancels, requests a refund, or initiates a chargeback within the 30-day verification period, the commission will be reversed and will not be paid.

5.3. Payments are processed through PartnerStack according to PartnerStack's payment schedule and minimum payout thresholds.

5.4. Affiliates are responsible for providing accurate payment information in their PartnerStack account and for any applicable taxes on commission income.

6. Promotional Guidelines

6.1. Permitted Activities

Affiliates may promote Beautiful.ai through the following organic channels:

• Content creation (blog posts, articles, reviews, tutorials)
• Social media posts and stories
• Email newsletters (to audiences who have opted in to receive communications)
• Video content (YouTube, TikTok, Instagram, LinkedIn)
• Podcast mentions and sponsorships
• Comparison and review websites

6.2. Paid Advertising

All paid advertising activity is prohibited unless explicitly approved in writing by Beautiful.ai. This includes, but is not limited to, paid search (Google Ads, Bing Ads, or any other search advertising platform), paid social media advertising, display advertising, native advertising, and any other form of paid media placement.

Affiliates who wish to conduct paid advertising to promote Beautiful.ai must submit a written request to marketing@beautiful.ai describing the intended paid channels, targeting, ad copy, and budget. Beautiful.ai will review each request and provide written approval or decline at its sole discretion. Any paid advertising conducted without prior written approval will be considered a violation of these Terms and may result in termination from the Program and forfeiture of unpaid commissions.

6.3. Prohibited Activities

Affiliates must NOT:

• Engage in cookie stuffing, click fraud, ad fraud, or any form of artificial traffic generation.
• Create websites, domains, or social media accounts that impersonate Beautiful.ai or could reasonably be confused with official Beautiful.ai properties.
• Send unsolicited emails (spam) or use any promotional method that violates applicable laws, including CAN-SPAM, GDPR, and CCPA.
• Make false, misleading, or unsubstantiated claims about Beautiful.ai, its products, pricing, or features.
• Modify, alter, or misuse Beautiful.ai trademarks, logos, or brand assets beyond what is provided through the affiliate asset library.
• Place affiliate links in pop-ups, pop-unders, or any other intrusive ad formats without prior written approval.
• Apply to the Program under multiple accounts or identities.

6.4. Coupon and Deal Sites

• Affiliates operating coupon, deal, cashback, or loyalty sites may participate in the Program.
• Commission rates for coupon and deal site affiliates may differ from standard rates and will be communicated individually upon application approval.
• Coupon and deal site affiliates must only promote authorized offers and discount codes provided by Beautiful.ai. Creating or distributing unauthorized coupon codes is prohibited.

6.5. Content Repurposing

• Beautiful.ai may request permission to repurpose Affiliate-created content (reviews, videos, social posts) for its own marketing purposes, including paid advertising.
• Such repurposing will only occur with the Affiliate's explicit consent and, where applicable, appropriate credit.

7. Brand Usage and Creative Assets

7.1. Affiliates will receive access to approved brand assets, banners, and creative materials through the PartnerStack dashboard.

7.2. All use of Beautiful.ai branding must comply with Beautiful.ai's brand guidelines, which will be provided to approved Affiliates.

7.3. Affiliates must not modify Beautiful.ai logos, brand colors, or approved creative assets without prior written approval.

7.4. Affiliates must clearly disclose their affiliate relationship with Beautiful.ai in accordance with applicable laws and regulations, including FTC Endorsement Guidelines. Disclosure must be clear and conspicuous in any content that includes affiliate links.

8. Fraud Prevention

8.1. Beautiful.ai takes a zero-tolerance approach to fraud. Any of the following will result in immediate termination from the Program and forfeiture of unpaid commissions:

• Generating fake leads, clicks, impressions, or sign-ups
• Using bots, scripts, or automated tools to generate referrals
• Incentivizing sign-ups without disclosure (e.g., paying people to sign up through your link without disclosing the affiliate relationship)
• Applying to the Program under multiple identities or accounts
• Manipulating tracking cookies or attribution
• Any activity designed to artificially inflate commissions

8.2. Beautiful.ai reserves the right to withhold or reverse commissions pending investigation of suspected fraudulent activity.

8.3. Beautiful.ai may use third-party fraud detection tools and manual review processes to monitor affiliate activity.

9. Compliance and Disclosures

9.1. Affiliates must comply with all applicable laws, regulations, and industry guidelines in the jurisdictions in which they operate, including but not limited to:

• FTC Endorsement Guidelines (US)
• ASA CAP Code (UK)
• GDPR (EU/EEA)
• CAN-SPAM Act
• CCPA (California)
• Any other applicable consumer protection or advertising regulations

9.2. Affiliates must clearly and conspicuously disclose their material relationship with Beautiful.ai whenever promoting the product. Acceptable disclosures include but are not limited to: "#ad," "#affiliate," "#sponsored," or "This post contains affiliate links."

9.3. Affiliates are solely responsible for ensuring their promotional content complies with applicable laws and regulations.

10. Confidentiality

10.1. Any non-public information shared with Affiliates, including but not limited to commission rates, program strategies, product roadmaps, and internal communications, is confidential and must not be disclosed to third parties without prior written consent from Beautiful.ai.

11. Intellectual Property

11.1. Beautiful.ai retains all rights, title, and interest in its trademarks, logos, brand name, product, and all associated intellectual property.

11.2. Participation in the Program does not grant Affiliates any ownership rights in Beautiful.ai's intellectual property. The license to use Beautiful.ai's brand assets is limited to program-related promotional activities and may be revoked at any time.

12. Limitation of Liability

12.1. Beautiful.ai is not responsible for any losses, damages, or costs incurred by Affiliates in connection with their participation in the Program, including but not limited to advertising costs, content creation costs, or lost commissions due to program changes or termination.

12.2. Beautiful.ai's total liability to any Affiliate under these Terms shall not exceed the total commissions paid to that Affiliate in the 12 months preceding the claim.

13. Termination

13.1. Beautiful.ai may terminate an Affiliate's participation immediately and without notice if the Affiliate:

• Violates any provision of these Terms
• Engages in fraudulent activity
• Engages in activity that damages Beautiful.ai's brand or reputation

13.2. Upon termination:

• All outstanding verified commissions earned prior to termination will be paid according to the standard payment schedule.
• Any pending or unverified commissions may be forfeited at Beautiful.ai's discretion.
• The Affiliate must immediately cease all use of Beautiful.ai branding, logos, and creative assets.
• The Affiliate must remove or deactivate all affiliate links within 30 days of termination.

14. Modifications

14.1. Beautiful.ai reserves the right to modify these Terms at any time. Affiliates will be notified of material changes through PartnerStack and/or email.

14.2. Continued participation in the Program after notification of changes constitutes acceptance of the modified Terms.

15. Governing Law

15.1. These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws provisions.

15.2. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state or federal courts located in California. Both parties consent to the personal jurisdiction of such courts.
